Terms & Conditions

These terms set out how drivers, employers and referees may use AfriHire, what our verification badges mean, and the responsibilities each side carries.

1. Agreement to these terms

These Terms & Conditions govern your use of the AfriHire platform, including the Employment Passport, identity and employment verification, the driver and job marketplace, and all related communications. By creating an account or using the platform you agree to these terms.

If you use AfriHire on behalf of a company, you confirm you are authorised to bind that company, and “you” includes that company.

2. Eligibility and accounts

  • You must be at least 18 years old and legally permitted to work or to recruit in your country.
  • You must provide accurate, current information and keep it up to date.
  • You are responsible for your credentials and all activity under your account. Tell us immediately if you suspect unauthorised access.
  • One person may hold one driver account. Employer accounts may have multiple named members, each individually accountable under these terms.
  • Accounts may not be shared, sold, transferred or scraped.

3. Verification — what it means and what it does not

AfriHire verifies what can reasonably be checked: that an identity document appears genuine and matches a live facial capture; that a named previous employer or referee confirmed a stated employment record; and that documents were supplied and reviewed.

Verification badges are evidence of completed checks at a point in time. They are not a guarantee of a person's competence, character, conduct, current licence validity, medical fitness or right to work, and they are not a recommendation to hire. Employers remain responsible for their own pre-employment due diligence, licence and medical confirmation, and legal compliance.

4. Driver obligations

  • Submit only your own genuine identity and licence documents. Submitting forged, altered or another person's documents is grounds for immediate permanent removal and may be reported to authorities.
  • Declare employment history truthfully and name only real employers and referees who can confirm it.
  • Keep licence and certificate expiry dates current.
  • Do not misrepresent your experience, licence classes or availability.

5. Employer obligations

  • Complete company verification honestly, including registration and tax identifiers and any compliance documents requested.
  • Post only genuine vacancies with accurate role, location, pay and contract information. No fee-charging, training-fee, pyramid, or bait vacancies.
  • Use candidate data only to assess that candidate for the role concerned. Do not resell, redistribute, bulk-export or add candidate data to any external database or marketing list.
  • Comply with applicable labour, non-discrimination, immigration and data protection law, and with any minimum standards we publish for employers on the platform.
  • Respond to employment verification requests you receive truthfully and only about records you can confirm from your own employment records.

6. The Employment Passport

Your Employment Passport belongs to you. You choose whether to publish a public passport link, which shows a limited public summary and no contact details or documents. You may unpublish it at any time.

AfriHire may correct, suspend or remove a badge if new evidence shows the underlying check was wrong, fraudulent or has expired. We will tell you when we do this and why.

7. Acceptable use

  • No fraud, impersonation, or misrepresentation of identity, employment or company status.
  • No harassment, discrimination, threats or abusive messaging.
  • No automated scraping, crawling, bulk downloading, or attempts to bypass rate limits, access controls or authentication.
  • No probing, penetration testing or interference with platform security or infrastructure without our prior written consent.
  • No uploading malware, or content you have no right to share.
  • No use of the platform to recruit for illegal work or to circumvent labour protections.

8. Fees

Driver accounts and the Employment Passport are free to create and maintain. Employer plans and paid features are charged at the rates shown on our pricing page at the time of purchase, exclusive of applicable taxes.

Subscriptions renew for the same term unless cancelled before renewal. Fees already paid for a started period are non-refundable except where required by law. We will give at least 30 days' notice before a price change affecting your renewal.

9. Intellectual property

AfriHire owns the platform, its software, design, brand and the AfriHire and Employment Passport names and marks. You receive a limited, non-exclusive, revocable licence to use the platform for its intended purpose.

You keep ownership of the content you submit and grant AfriHire a licence to host, process, display and transmit it as necessary to operate the platform and to perform verification.

10. Suspension and termination

You may close your account at any time in Settings. We may suspend or terminate access — immediately where the risk is serious — if you breach these terms, submit fraudulent information, endanger other users, or use the platform unlawfully.

On termination, your marketplace visibility ends. We retain records for the periods stated in the Privacy Policy where we have a legal or anti-fraud reason to do so.

11. Disclaimers

The platform is provided “as is” and “as available”. To the fullest extent permitted by law we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation.

AfriHire is not a party to any employment relationship formed through the platform, is not an employer or employment agency of record for those relationships, and is not responsible for the acts or omissions of any driver or employer.

12. Limitation of liability

To the maximum extent permitted by law, AfriHire is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.

Our total aggregate liability arising out of or relating to the platform is limited to the greater of the amounts you paid us in the 12 months before the claim, or USD 100. Nothing here limits liability that cannot be limited by law, including for fraud or death or personal injury caused by negligence.

13. Indemnity

You will indemnify AfriHire against claims, losses and reasonable legal costs arising from your breach of these terms, your unlawful use of the platform, your misuse of another user's data, or content you submitted.

14. Governing law and disputes

These terms are governed by the laws of the Republic of Zambia, without regard to conflict-of-law rules. Disputes will be brought before the competent courts of Lusaka, Zambia, except where mandatory local law gives you the right to proceed in your own jurisdiction.

Before starting formal proceedings, please contact us so we can attempt to resolve the matter directly.

15. Changes and contact

We may update these terms as the platform evolves. Material changes take effect 30 days after we notify you in the product or by email; continued use after that date means acceptance. If you do not accept the change, you may close your account.
